Connecticut Lemon Laws
 

 

The lemon laws in the State of Connecticut cover comprehensively both the new and the used vehicles. It is mandated that for a used vehicle, the dealer must provide an express warranty of 30 days or 1500 miles, if the cost of the sale is of $3000- 5000.

Manufacturers’ / dealers’ obligations

If a new vehicle does not live up to the warranty, then the manufacturer must make such repairs as are necessary. The consumer is required to intimate to the manufacturer about the defect.

If the repair is not effected successfully even after four attempts or thirty days of down time then, the manufacturer can replace or refund the vehicle.

A dealer too has to honor his warranty commitments in case of any defect to the vehicle.

In case the vehicle is refunded, then the manufacturer has to refund along with the contract price, all the incidental charges incurred by the consumer due to the defect. He can however deduct some amount attributable to the normal ware of the vehicle.

In case such a returned vehicle is to be resold, then the manufacturer will have to notify to the new buyer the reasons for the resale and give details of the defects in the vehicle.

Dispute resolution

The manufacturer may set up an alternative dispute settlement mechanism to settle all warranty disputes. In this case, the consumer will be mandated o approach this forum first and then only will he be eligible for other remedies under this statute.

If he is unsatisfied with the award then the consumer may approach the court for relief. If successful, he will be entitled for damages as well as costs.

The US federal law governing lemons is officially called The Magnuson-Moss Warranty Act, however, most American states each have their own lemon law.
