Nevada Lemon Laws

The Nevada revised statute 597.600 to 597.680 deal with lemon laws in the state.

Dealers duties and obligations

Once he has received a written intimation regarding the defect of a vehicle in warranty from the consumer, he is duty bound to carry out such repairs as he deems fit.

If even after a minimum of four repair attempts or keeping the vehicle off the road for more that thirty days due to repairs, the defect is not rectified, then, the manufacturer has to either replace the vehicle of refund the amount.

In case of a refund, then the manufacturer shall refund not only the price of the vehicle but all incidental expenses of the consumer as well, including taxes, license fees, etc.

Consumers’ rights and obligations

The consumer has to give a written notification to the manufacturer about the defect in the vehicle within the warranty period.

If he wishes to start any civil action against the manufacturer, then such an action must begin within eighteen months of the delivery of the vehicle.

The consumer cannot be deprived of any of his rights under this chapter by any agreement signed with the manufacturer.

Further, he is not barred from seeking remedy under any other law for the time being in force in addition to the remedies available under this chapter.

The US federal law governing lemons is officially called The Magnuson-Moss Warranty Act, however, most American states each have their own lemon law.
