Oklahoma Lemon Laws
 

 

This statute deals with the lemon law regarding new vehicles sold in the state or Oklahoma. It gives the consumers the right to seek redressal of his grievances in case any defect is encountered in the newly purchased vehicle.

The manufacturer has to, either himself or through any of his agents, take all such steps in order to repair the vehicle as soon as he receives a written intimation of the defect from the consumer.

The consumer should notify the manufacturer about the defect either within the period of warranty, or within one year from the delivery of the vehicle, whichever is earlier.

In the event that the defect is not rectifies even after sincere efforts, then the manufacturer may either replace the vehicle with a new comparable one, or refund the price paid to the buyer. In the event of a refund, the manufacturer has to refund not only the actual price paid, but also the incidental expenses like taxes, license and registration fees etc. paid by the consumer.

It manufacturer would be granted a minimum of four attempts at repairing the vehicle. He may also cause the vehicle to remain un-operational for a period of maximum 45 days due to the repairs.

If all the above fails, then the manufacturer may set-up an informal arbitration mechanism to settle the disputes of warranty. The consumer would be then mandated to seek remedy there first before approaching any other forum under this Act.

However, no provision in this Act takes away the consumer’s rights to seek relief under any other applicable law for the time being in force.

The US federal law governing lemons is officially called The Magnuson-Moss Warranty Act, however, most American states each have their own lemon law.
